Chadron Hair Case for Monday, Feb. 9, Lincoln Evening Journal Nebraska State Journal 15 By ROGER HIRSCH Attorneys for Dr. Edwin Nelson, president of Chadron State College, and Chadron sophomore Robert E. Reichenberg Jr. were scheduled to argue Monday afternoon whether Reichenberg should have got a haircut before attempting to reenter Chadron State College for second semester classes.

A hearing was scheduled fur Monday afternoon in Federal District Court on a suit brought by Reichenberg to test the constitutionality of Dr. interpretation of the school grooming code. Reichenberg was denied readmission to the school for second semester classes because the length of his moustache, sideburns and hair e.xceeded limits prescribed by an institutional dress and grooming code. According to the trial brief filed by Nelson, the Chadron State College president will argue the issues in the case have not been defined enough to permit a constitutional determination Reichenberg does not have to adhere to a grooming code. attorneys argue that although the case may seem trivial matter over an inch or so of what is stake is whether a young man is an individual or a pawn of the according to the trial brief.

attorneys argue that Reichenberg does not have a federally guaranteed right to attend the school. is common knowledge that conditions precedent to attending college have always been imposed on the right to attend state according to the trial brief argument. attorneys argue the U.S. Supreme Court was faced with a similar situation in a case, and rejected the that it was to condition public employment on such an oath because is no constitutionally protected right to public according to the trial brief. According to brief, the college president argues the state may regulate the hair style of the college student.

is not a valid classification to say men with long hair represent a class of people (entitled to constitutional protection) as hair length is merely a style that can be changed easily and according to the trial brief. attorneys urge that wearing of hair is a matter of personal taste and an expression of the individual according to their trial brief. The wearing of hair is a of shifting and tastes and may be an expression of religious belief, as with llassidic Jews, or of cultural pride, as with Afro haircuts, or an Indian with braided according to Reichenberg's trial brief. According to trial brief, his atrorneys argue the standard in the code is justifiable because preparation for the career of teaching should be in the hands of professionals, and it not only includes the training and instruction of persons but also the teaching of discipline and good grooming, if in the mature Judgment and opinion of the professional that it is necessary and proper to maintain the high standards of such According to trial brief, his attorneys argue he has no compaint with right to make regulations reasonably related to its education functions.

Apartment Shortage Seen For Lincoln in Coming Summer Lodge "Sunday Journal and Star" has it. An apartment shortage forecast for Omaha this summer does not appear to apply to Lincoln, according to James Johnson, president of the Home Builders Assn. of Lincoln (HBAL).

A two-year forecast by the U.S. Office of Housing and Red Election Nanterre, France (JFI Waldeck Rochet was reelected French Communist party at the close of its 19th congress Sunday, but because he is ill the new post of assistant secretary-general was created. The congress named Georges Marchais, 49, to it. Urban Development (HUD) indicated a need in Lincoln for 900 housing units annually, Johnson said. That figure was divided into 500 single-family units and 400 multi-family (apartment) units.

But a four-year survey of building in Lincoln conducted by HBAL executive secretary Herman Hempel indicates construction in both categories has been exceeding that mark. In 1966 apartment building amounted to 103 units. The total was increased to 245 in 1967, 709 in 1968 and 777 in 1969. Permits issued for January amounted to 32 units, just under the 1969 total. Single family dwelling construction amounted to 437 units In 1966, 528 in 1967, 469 in 1968 aid 455 in 1969.

Permits issued in January totaled 11, the same as in the same month last year. Hempel said the shortage now is for housing for low- income families but he expects some provision to be made for who afford a $25,000 Progress in this area will be slow, he predicted, because of the tight money situation and the increasing costs of money, labor and material but he said he felt confident that Lincoln builders can handle the situation.
