Error from Douglas county. This is a case brought to secure the reversal of a jury verdict and judgment rendered by Judge Melville R. Hopewell in an action for damages brought by Hart, who claimed that he had been employed by the packing company as general foreman at a salary of $2,500 per year, and had been discharged without cause at the end of about seven months. He was paid $1,666.66 and sued for the remaining $33.33, for which he secured judgment. The Esterly Harvesting company vs.

Frank Frolkey, error from Lincoln county. This is a case brought to secure the reversal of judgment rendered in the above county for $1 and $194,48 costs. This is a case to secure the reversal of a judgment upon a verdict finding the plaintiff in error guilty of the crime of larceny from the person of one Mrs.

Stat Hoom, The following new cases have been filed in supreme court since The Journal's last report: Emma Honisky vs. M. A. Kennedy, error from Fillmore county. This case is known as the "Father Kennedy case." The defendant was a Catholic priest in charge of a parish in the above named county.

The plaintiff was a Bohemian girl of seventeen years of age who was employed as housekeeper for defendant. On the 15th day of May, 1889, the plaintiff filed a complaint before D. H. Co-nant, county judge of Fillmore county, charging that she was pregnant with a bastard child of which Father Kennedy was the father. The priest was arrested and brought into court and an examination ensued.

The girl testified that the criminal act had been twice committed once between Christmas and New Years and once just after New Years day. She related minutely the circumstances and the defense, in its cross examination, which endeavored chiefly to establish the presumed fact that she bad been intimate with one Jim Mc Bride and one Tom Fox, failed to shake her testimony or show anything improper in her relations with others. The county judge found that the girl's answers established her complaint and required the defendant to give bonds in the sum of $1,000. He furnished bail and was released. September came and the child was born on the 22d thereof.

On the 26th of the succeeding month, before the term of court at which defendant was bound to appear the baby died. Therefore when court convened in November defendant moved that the cause be dismissed and the defendant discharged from his bond because of the death of the alleged bastard child, and the question presented and passed upon by Judge Morris of the district court was, "Does the cause under the complaint of the plaintiff abate under our statute by reason of the death of the child of which the complaint alleges the defendant to be the father." Judge Morris held that the death of the child abated the quasi criminal action for bastardy, and that the plaintiff had her suit for damages, is any there were, in another action. He therefore sustained the motion of the defendant, dismissed the case, discharged the defendant from his bond and taxed the costs incurred up against the respective parties by whom they were incurred. The plaintiff contends that the court erred in its decision and submitted its bill of exceptions, and accompanying his Was drawn again 1 1 Mil i i e4 R. L.
